1. Scope of Application, Changes

These Terms of Service (ToS) of Smart-Stamp AG, Rothausstrasse 1, 8280 Kreuzlingen, Switzerland (hereinafter referred to as “Smart-Stamp”) apply to the use of the Smart-Stamp app (the “App”) pro-vided to you (“User”) by SmartStamp. The use of the App provided by SmartStamp is permitted exclusively on the basis of the following ToS. When you create an account, you must select the checkbox by which you confirm that you accept the following ToS. By clicking the “Sign Up” button, you agree to these ToS in full. The ToS can be viewed and downloaded at any time on the website www.smart-stamp.com. These ToS refer exclusively to your use of the app. Additional ser-vices are not owed on the basis of these terms of service.

2. License Agreement (EULA)

SmartStamp grants you a non-exclusive, revocable and non-trans-ferable right to use the App, subject to your compliance with all ap-plicable laws, these License Terms and all applicable terms and conditions available on the applicable App Store / Play Store. No other rights are granted to you. Any form of sub-licensing, renting and/or distribution of the App or rights to use the App are prohibited.

3. Updates

The App is provided as a dynamic and evolving product. Smart-Stamp reserves the right to extend, update or modify the App at any time at its sole discretion, in particular to add, modify or remove in-dividual functions. These license terms also apply to updates or re-visions to this App. To ensure correct and stable functionality of the App, you must install the latest version/update of the App. Smart-Stamp is not obligated to maintain support for older versions/up-dates and does not guarantee the compatibility of older versions/up-dates with newer hardware operating systems. You are not entitled to receive updates to the App to enhance the functionality of the App.

4. Limitations

You accept the following restrictions: You may not use the App for any illegal activity or purpose. Further, you may not use the App in any way that violates these License Terms or any applicable law, including, without limitation, applicable copyright law, privacy law, or any other rights of any third party; in particular, you may not use the App for pornography, child pornog-raphy, cyber mobbing, fraud, theft, terrorism, etc. You may only share or transfer items to other users if you know that the other user is willing to receive the item. You are not allowed to create multiple accounts. You may not use the App to gain unauthorized access to Smart-Stamp’s products or services or otherwise compromise its systems and infrastructure; You may not distribute, sell, rent, license, sublicense or otherwise make the App available to third parties without the prior consent; You may not transmit any viruses or malware or cause any other activity that compromises the App or SmartStamp’s services or pro-ducts or SmartStamp’s systems and infrastructures; You may not translate, decompile, reverse engineer or create deriv-ative works of the App, except as expressly permitted by mandatory law. The foregoing restrictions do not apply to individual components used in the App that are subject to open source license terms. For these components, the relevant open source license terms apply. If you do not comply with these restrictions, SmartStamp may de-lete your items, even if you have paid for them, and close your ac-count. If third parties make claims that these restrictions may have been violated, we reserve the right to block content and objects until final legal clarification.

5. Services of SmartStamp

The scope of services of the individual services results from the cur-rent description of the respective services at the time of use. With the app, characteristics of the photographed objects (“finger-prints”) can be found and stored from suitable digital photographs of objects (“initial registration”). The photograph together with the fin-gerprints is defined as an “Object”. When a new photograph of an object is taken for verification (“verifi-cation”), the app can check whether these fingerprints can also be found there, which indicates with a certain probability that it is the same object. The app logs relevant data in a logbook secured with blockchain technology.

PREREQUISITES:

- Supported cell phone with macro lens;

- The object to be photographed is flat, inanimate, solid, non-reflec-tive, non-transparent, and has a surface area of at least 2 x 2 cm;

- Photographs must be taken 2 cm above the surface;

- The area of the surface of the object from which the photographs were taken is not damaged;

- The underlying surface contains sufficient information;

- The same cell phone is used for verification that was used for the initial capture.

During verification, the app gives a strong indication of whether an item is the same item that was first registered. No other statements are associated with it. SmartStamp does not guarantee any usabil-ity for a specific purpose, especially not the suitability of fingerprints for legal purposes such as evidence before authorities or courts. SmartStamp points out to the customer that it is not a back-up ser-vice. The customer is responsible for the storage of images.

STORAGE PERIOD

Objects that have not been paid for can be removed or deleted by SmartStamp at any time. However, the customer can upgrade individual objects against pay-ment, which guarantees him the specified storage period, subject to compliance with these terms and conditions.

LICENSE

When you upload photos, you granted SmartStamp a simple, non-exclusive, revocable, transferable right to store and use the photos in the App. If you transfer the item to another user, you also grant the other user a corresponding license. If you upload photos of copyrighted works, you affirm that you are entitled to do so and also grant a simple, non-exclusive, revocable, transferable right to store and use the copyrighted work in the app. This applies accordingly if you transfer the Object to another user.

6. Liability

THE APP IS PROVIDED TO YOU ON AN “AS IS” BASIS. SMART-STAMP MAKES NO REPRESENTATIONS, WARRANTIES OR EN-DORSEMENTS OF ANY KIND WITH RESPECT TO THE APP OR THE SUITABILITY OF THE APP, UNLESS OTHERWISE EX-PRESSLY STATED. IN ANY EVENT, SMARTSTAMP CANNOT GUARANTEE THAT THE APP WILL BE ACCESSIBLE WITHOUT INTERRUPTION OR TEMPORARY IMPAIRMENT OF ITS FUNCTIONALITY AS AN APP. SMARTSTAMP CANNOT GUARANTEE THAT THE APP WILL CONTINUE TO BE PUBLISHED IN THE PLAY STORE OR APP STORE OR THAT FUTURE ANDROID OR IOS VERSIONS WILL BE SUPPORTED. LIABILITY AND WARRANTY IS EXPRESSLY DISCLAIMED FOR THOSE VERSIONS OF THE APP THAT ARE NOT INTENDED FOR END USERS (TEST, PILOT, ALPHA, BETA OR SIMILAR VERSIONS). YOU AGREE THAT YOU UNDERSTAND AND AC-CEPT THE RISKS ASSOCIATED WITH THE USE OF SUCH PRO-GRAMS; IN PARTICULAR, THAT MALFUNCTIONS OR DATA LOSS MAY OCCUR. THE USE OF SUCH PROGRAMS IS AT YOUR OWN RISK AND WILL RESULT IN A COMPLETE DIS-CLAIMER OF WARRANTY AND LIABILITY. SMARTSTAMP SHALL BE LIABLE WITHOUT LIMITATION FOR DAMAGES CAUSED BY WILLFUL MISCONDUCT, GROSS NEG-LIGENCE OR INTENTIONAL MISCONDUCT AND IN ACCORD-ANCE WITH THE PRODUCT LIABILITY LAW. IN CASES OF SIM-PLE NEGLIGENCE, SMARTSTAMP SHALL ONLY BE LIABLE WITHOUT LIMITATION FOR DAMAGES RESULTING FROM IN-JURY TO LIFE, BODY OR HEALTH OF PERSONS. IN ALL OTHER CASES OF ORDINARY NEGLIGENCE, SMARTSTAMP SHALL ONLY BE LIABLE TO THE EXTENT THAT SMARTSTAMP BREACHES A MATERIAL CONTRACTUAL OBLIGATION, I.E. AN OBLIGATION THAT IS ESSENTIAL FOR THE PROPER PERFOR-MANCE OF THESE LICENSE TERMS AND ON WHICH YOU RELY OR MAY RELY ON A REGULAR BASIS — IN THIS CASE, SMARTSTAMP’S LIABILITY TO YOU SHALL BE LIMITED TO THE TYPICAL FORESEEABLE DAMAGE. IF YOU ARE AN ENTRE-PRENEUR, THE LIABILITY FOR SIMPLE NEGLIGENCE IS ALSO LIMITED TO THE AMOUNT OF THE CONTRACTUAL FEES THAT YOU HAVE PAID TO SMARTSTAMP FOR THE PERIOD OF TWO YEARS PRIOR TO THE OCCURRENCE OF THE DAMAGING EVENT WITHIN THE FRAMEWORK OF THE SPECIFIC CON-TRACTUAL RELATIONSHIP. FURTHER CLAIMS FOR DAMAGES DUE TO SIMPLE NEGLIGENCE ARE EXCLUDED. THE INVOCATION ON SOFTWARE DEFECTS IS EXCLUDED IN-SOFAR AS YOU DO NOT CARRY OUT THE SOFTWARE UP-DATES OFFERED BY SMARTSTAMP AND MADE AVAILABLE ONLINE AND THE DEFECT COULD HAVE BEEN AVOIDED BY THE SOFTWARE UPDATES MADE AVAILABLE. THIS ALSO AP-PLIES TO SECURITY GAPS THAT OCCUR DUE TO THE FACT THAT THE SOFTWARE UPDATE PROVIDED WAS NOT IN-STALLED BY THE USER OR WAS CANCELLED DURING IN-STALLATION. YOU ARE AWARE THAT NO CLAIMS FOR DAMAGES CAN BE ASSERTED AGAINST SMARTSTAMP ARISING FROM YOUR NEGLIGENT, UNAUTHORIZED OR ILLEGAL SECURITY MECHA-NISMS, IN PARTICULAR WITHIN YOUR OWN LAN OR MOBILE DEVICE, OR FROM THE USE OF THE APP CONTRARY TO THE LICENSE TERMS. YOU MUST ENSURE THAT THE APP IS NOT MISUSED BY THIRD PARTIES AND MUST SECURE ACCESS TO THE APP. IF THE DEVICE ON WHICH THE APP IS ACCESSIBLE IS LOST (E.G., DUE TO LOSS, THEFT, ETC.), YOU ARE RESPONSIBLE FOR IMMEDIATELY REVOKING ALL ACCESS PRIVILEGES WITH APPROPRIATE MECHANISMS TO PREVENT UNAUTHOR-IZED ACCESS TO THE APP.

7. Termination of the contractual relationship

Both SmartStamp and you may terminate this contractual relation-ship at any time. Notwithstanding the foregoing, SmartStamp may terminate this contractual relationship only with two weeks’ notice. The legal right of the parties to terminate this contractual relation-ship without notice for good cause remains unaffected. In particular, SmartStamp is entitled to terminate this contractual relationship im-mediately without notice in the event of a material breach by you of the terms and conditions set forth in the ToS. The termination of the contractual relationship will result in the with-drawal of your right to use the App; the use of the App must be dis-continued immediately.

8. Changes to the ToS

SmartStamp may amend these ToS with a reasonable period of no-tice. If you do not object to the amendment within a reasonable pe-riod set by SmartStamp, the amendment shall be deemed ap-proved. SmartStamp will inform you in the amendment notice that the amendment will become effective if you do not object within the set period. In the event of an objection, SmartStamp may terminate the contractual relationship with a notice period of two (2) weeks. SmartStamp may send information and statements concerning the contractual relationship to the customer’s e‑mail address.

9. Applicable law and place of jurisdiction

For disputes arising from this contract, including its existence, the registered office of SmartStamp is the exclusive place of jurisdic-tion. Swiss law is agreed upon.

10. Language Versions

In the event that different interpretations are possible between the German and English versions of these ToS, the German version shall prevail.

Diese allgemeinen Geschäftsbedingungen (AGB) der SmartStamp AG, Rothausstrasse 1, 8280 Kreuzlingen, Schweiz (nachfolgend «SmartStamp») gelten für die Nutzung der SmartStamp App (die «App»), die Ihnen (« Nutzer») von SmartStamp zur Verfügung ge-stellt wird. Die Nutzung der von SmartStamp angebotenen App ist ausschliesslich aufgrund der nachstehenden AGB zulässig. Wenn Sie einen Account erstellen, müssen Sie die Checkbox aus-wählen, mittels der Sie bestätigen, die nachfolgenden AGB zu ak-zeptieren. Durch das Anklicken des „Sign Up“- Buttons stimmen Sie diesen AGB vollständig zu. Die AGB sind jederzeit auf der Website www.smartstamp.com einzusehen und herunterladbar. Diese AGB beziehen sich ausschliesslich auf Ihre Nutzung der App. Darüberhinausgehende Leistungen werden auf Grund dieser AGB nicht geschuldet.

2. Lizenzbestimmungen (EULA)

SmartStamp gewährt Ihnen ein einfaches, nicht exklusives, wider-rufliches und nicht übertragbares Recht zur Nutzung der App, vor-behaltlich Ihrer Einhaltung aller geltenden Gesetze, dieser Lizenz-bestimmungen und aller anwendbaren Bedingungen, die im jeweili-gen App Store / Play Store verfügbar sind. Ihnen werden keine wei-teren Rechte eingeräumt. Jede Form der Unterlizenzierung, Ver-mietung und/oder des Vertriebs der App oder der Nutzungsrechte an der App sind untersagt.

3. Aktualisierungen

Die App wird als dynamisches und sich entwickelndes Produkt zur Verfügung gestellt. SmartStamp behält sich vor, die App jederzeit nach eigenem Ermessen zu erweitern, zu aktualisieren oder zu mo-difizieren, insbesondere einzelne Funktionen hinzuzufügen, zu mo-difizieren oder zu entfernen. Diese Lizenzbestimmungen gelten ebenfalls für Aktualisierungen oder Überarbeitungen dieser App. Um die korrekte und stabile Funktionalität der App zu gewährleis-ten, müssen Sie die neueste Version/Aktualisierung der App instal-lieren. SmartStamp ist nicht verpflichtet, die Unterstützung für ältere Versionen/Aktualisierungen aufrechtzuerhalten und garantiert nicht die Kompatibilität älterer Versionen/Aktualisierungen mit neueren Hardware-Betriebssystemen. Sie haben keinen Anspruch auf Zur-verfügungstellung von Aktualisierungen der App zur Erweiterung der Funktionen der App.

4. Beschränkungen

Sie akzeptieren die nachfolgenden Beschränkungen: Sie dürfen die App nicht für illegale Aktivitäten oder Zwecke ver-wenden. Ferner dürfen Sie die App nicht in einer Weise verwenden, die diese Lizenzbedingungen oder geltendes Recht, insbesondere das geltende Urheberrecht, Datenschutzrecht, oder sonstige Rechte Dritter verletzt; insbesondere darf die App nicht für Porno-grafie, Kinderpornografie, Cybermobbing, Betrug, Diebstahl, Terro-rismus usw. verwendet werden. Sie dürfen Objekte nur dann mit anderen Nutzern teilen bzw. an an-dere Nutzer übertragen, wenn Sie wissen, dass der andere Nutzer bereit ist, das Objekt zu erhalten. Es ist Ihnen nicht erlaubt, mehrere Konten zu erstellen. Sie dürfen die App nicht verwenden, um unberechtigten Zugang zu Produkten oder Diensten von SmartStamp zu erhalten oder um in sonstiger Weise die Systeme und Infrastrukturen zu gefährden; Sie dürfen ohne die vorherige Zustimmung die App nicht vertreiben, verkaufen, vermieten, lizenzieren, unterlizenzieren oder Dritten in sonstiger Weise zugänglich machen; Sie dürfen nicht Viren oder Malware übermitteln oder sonstige Akti-vitäten veranlassen, die die App oder Dienste oder Produkte von SmartStamp oder die Systeme und Infrastrukturen von SmartStamp gefährden; Sie dürfen die App nicht übersetzen, dekompilieren, zurückentwi-ckeln oder abgeleitete Werke erstellen, es sei denn, dies ist durch zwingende gesetzliche Regelungen ausdrücklich erlaubt. Die vorgenannten Restriktionen finden keine Anwendung auf ein-zelne in der App verwendete Komponenten, die Open Source Li-zenzbedingungen unterliegen. Für diese Komponenten gelten die jeweils einschlägigen Open Source Lizenzbedingungen. Sollten Sie sich nicht an diese Beschränkungen halten, kann Smart-Stamp Ihre Objekte löschen, auch wenn Sie für diese bezahlt ha-ben, und Ihr Konto schliessen. Wenn Dritte Ansprüche geltend ma-chen, wonach eine Verletzung dieser Beschränkungen möglich er-scheint, behalten wir vor, Inhalte und Objekte bis zur endgültigen rechtlichen Klärung zu sperren.

5. Leistungen von SmartStamp

Der Leistungsumfang der einzelnen Leistungen ergibt sich aus der zum Zeitpunkt der Inanspruchnahme aktuellen Beschreibung der je-weiligen Leistungen. Mit der App können aus geeigneten digitalen Fotografien von Ge-genständen Merkmale der fotografierten Gegenstände («Finger-prints») gefunden und gespeichert werden («Erstregistrierung»). Die Fotografie zusammen mit den Fingerprints wird als «Objekt» definiert. Bei einer neuen Aufnahme eines Gegenstands zur Verifizierung («Verifizierung») kann die App prüfen, ob diese Fingerprints auch dort zu finden sind, was mit einer gewissen Wahrscheinlichkeit da-für spricht, dass es sich um denselben Gegenstand handelt. Die App protokolliert relevante Daten in einem Logbuch, das mit Block-chain-Technologie gesichert ist.

VORAUSSETZUNGEN:

- Unterstütztes Mobiltelefon mit Makrolinse;

- Der zu fotografierende Gegenstand ist flach, unbelebt, fest, nicht reflektierend, nicht transparent und hat eine Oberfläche von min-destens 2 x 2 cm;

- Die Fotografien müssen 2 cm über der Oberfläche abgenommen werden;

- Der Bereich der Oberfläche des Gegenstands, von dem die Foto-grafien genommen wurden, ist nicht beschädigt;

- Die zugrunde liegende Oberfläche enthält genügend Informatio-nen;

- Es wird dasselbe Mobiltelefon für Überprüfung verwendet, wel-ches auch die Erstaufnahme verwendet wurde. Bei der Verifizierung gibt die App einen starken Hinweis darauf, ob es sich bei einem Gegenstand um denselben Gegenstand handelt, das zuerst registriert wurde. Weitere Aussagen sind damit nicht ver-bunden. SmartStamp garantiert keine Verwendungsfähigkeit für ei-nen spezifischen Zweck, insbesondere nicht die Eignung Finger-prints zu rechtlichen Zwecken wie Beweisführung vor Behörden oder Gerichten. SmartStamp weist den Kunden darauf hin, dass es kein Backup-Dienst ist. Für die Speicherung von Bildern ist der Kunde selbst ver-antwortlich.

SPEICHERDAUER

Nicht bezahlte Objekte können jederzeit von SmartStamp entfernt oder gelöscht werden. Der Kunde kann allerdings einzelne Objekte gegen Bezahlung up-graden, womit ihm die angegebene Speicherdauer, vorbehaltlich der Einhaltung dieser AGB, gewährleistet wird.

LIZENZ

Wenn Sie Fotos hochladen, gewährten Sie SmartStamp ein einfa-ches, nicht exklusives, widerrufliches, übertragbares Recht zur Speicherung und Verwendung der Fotos in der App. Sofern Sie das Objekt an einen anderen Nutzer übertragen, erteilen Sie dem ande-ren Nutzer damit ebenfalls eine entsprechende Lizenz. Wenn Sie Fotos von urheberrechtlich geschützten Werken hochla-den, versichern Sie, hierzu berechtigt zu sein und erteilen in Bezug auf das urheberrechtlich geschützte Werk ebenfalls ein einfaches, nicht exklusives, widerrufliches, übertragbares Recht zur Speiche-rung und Verwendung in der App. Dies gilt wiederum entsprechend, wenn Sie das Objekt an einen anderen Nutzer übertragen.

6. Haftung

DIE APP WIRD IHNEN AUF EINER “AS IS”-BASIS ZUR VERFÜ-GUNG GESTELLT. SMARTSTAMP GIBT KEINE ZUSICHERUN-GEN, GARANTIEN ODER BESTÄTIGUNGEN JEGLICHER ART BEZÜGLICH DER APP ODER DER EIGNUNG DER APP AB, SO-FERN NICHT AUSDRÜCKLICH ETWAS ANDERES ANGEGEBEN WIRD. IN JEDEM FALL KANN SMARTSTAMP NICHT GARANTIEREN, DASS DIE APP OHNE UNTERBRECHUNGEN ODER VORÜBER-GEHENDE BEEINTRÄCHTIGUNGEN IHRER FUNKTIONALITÄT ALS APP ZUGÄNGLICH IST. SMARTSTAMP KANN NICHT GARANTIEREN, DASS DIE APP WEITERHIN IM PLAY STORE ODER APP STORE VERÖFFENT-LICHT WIRD ODER DASS ZUKÜNFTIGE ANDROID- ODER IOS-VERSIONEN UNTERSTÜTZT WERDEN. EINE HAFTUNG UND GEWÄHRLEISTUNG WIRD AUSDRÜCK-LICH FÜR SOLCHE VERSIONEN DER APP AUSGESCHLOSSEN, DIE NICHT FÜR ENDNUTZER BESTIMMT SIND (TEST‑, PILOT‑, ALPHA‑, BETAVERSIONEN ODER ÄHNLICHE). SIE SIND EIN-VERSTANDEN, DASS SIE DIE MIT DER NUTZUNG SOLCHER PROGRAMME VERBUNDENEN RISIKEN KENNEN UND AKZEP-TIEREN; INSBESONDERE, DASS FEHLFUNKTIONEN ODER DATENVERLUSTE AUFTRETEN KÖNNEN. DIE NUTZUNG SOL-CHER PROGRAMME LIEGT IN IHREM GEFAHRENBEREICH UND FÜHRT ZU EINEM VOLLSTÄNDIGEN GEWÄHRLEIS-TUNGS- UND HAFTUNGSAUSSCHLUSS. SMARTSTAMP HAFTET UNBESCHRÄNKT FÜR SCHÄDEN, DIE DURCH VORSATZ, GROBE FAHRLÄSSIGKEIT ODER VOR-SÄTZLICHES FEHLVERHALTEN VERURSACHT WERDEN UND NACH DER MASSGABE DES PRODUKTEHAFTPFLICHTGESET-ZES. IN FÄLLEN EINFACHER FAHRLÄSSIGKEIT HAFTET SMARTSTAMP NUR BEI SCHÄDEN AUS DER VERLETZUNG DES LEBENS, DES KÖRPERS ODER DER GESUNDHEIT VON PERSONEN UNBESCHRÄNKT. IN ALLEN ANDEREN FÄLLEN VON EINFACHER FAHRLÄSSIGKEIT HAFTET SMARTSTAMP NUR, SOWEIT SMARTSTAMP EINE WESENTLICHE VER-TRAGSPFLICHT VERLETZT, D.H. EINE SOLCHE PFLICHT, DIE FÜR DIE ORDNUNGSGEMÄSE DURCHFÜHRUNG DIESER LI-ZENZBESTIMMUNGEN UNERLÄSSLICH IST UND AUF DIE SIE SICH VERLASSEN ODER AUF DIE SIE SICH REGELMÄSIG VERLASSEN KÖNNEN — IN DIESEM FALL IST DIE HAFTUNG VON SMARTSTAMP IHNEN GEGENÜBER AUF DEN TYPI-SCHEN VORHERSEHBAREN SCHADEN BESCHRÄNKT. SO-WEIT SIE UNTERNEHMER SIND, IST DIE HAFTUNG BEI EINFA-CHER FAHRLÄSSIGKEIT ZUDEM BESCHRÄNKT AUF DIE SUMME DER VERTRAGLICHEN ENTGELTE, DIE SIE FÜR DEN ZEITRAUM VON ZWEI JAHREN VOR EINTRITT DES SCHÄDI-GENDEN EREIGNISSES IM RAHMEN DES KONKRETEN VER-TRAGSVERHÄLTNISSES AN SMARTSTAMP GEZAHLT HABEN. WEITERGEHENDE SCHADENSERSATZANSPRÜCHE DURCH EINFACHE FAHRLÄSSIGKEIT SIND AUSGESCHLOSSEN. DIE BERUFUNG AUF SOFTWAREMÄNGEL SCHEIDET AUS, SO-WEIT SIE DIE VON SMARTSTAMP ANGEBOTENEN UND ON-LINE ZUR VERFÜGUNG GESTELLTEN SOFTWAREAKTUALISIE-RUNGEN NICHT VORNEHMEN UND DER MANGEL DURCH DIE ZUR VERFÜGUNG GESTELLTE SOFTWAREAKTUALISIERUNG HÄTTE VERMIEDEN WERDEN KÖNNEN. DIESES GILT AUCH FÜR SICHERHEITSLÜCKEN, DIE DADURCH ENTSTEHEN, DASS DIE ZUR VERFÜGUNG GESTELLTE SOFTWAREAKTUA-LISIERUNG VOM NUTZER NICHT INSTALLIERT ODER WÄH-REND DER INSTALLATION ABGEBROCHEN WURDE. SIE SIND SICH BEWUSST, DASS GEGEN SMARTSTAMP KEINE SCHADENSERSATZANSPRÜCHE GELTEND GEMACHT WER-DEN KÖNNEN, DIE SICH AUS IHREN FAHRLÄSSIGEN, UNBE-FUGTEN ODER ILLEGALEN SICHERHEITSMECHANISMEN, INS-BESONDERE INNERHALB IHRES EIGENEN LANS ODER MO-BILGERÄTES, ODER AUS DER NUTZUNG DER APP ENTGE-GEN DEN LIZENZBESTIMMUNGEN, ERGEBEN. SIE HABEN DA-RAUF ZU ACHTEN, DASS DIE APP NICHT VON DRITTEN MISS-BRÄUCHLICH VERWENDET WIRD UND MÜSSEN DEN ZUGRIFF AUF DIE APP SICHERN. WENN DAS GERÄT, AUF DEM DIE APP ZUGÄNGLICH IST (Z.B. DURCH VERLUST, DIEBSTAHL ETC.), VERLOREN GEHT, SIND SIE DAFÜR VERANTWORTLICH, ALLE ZUGRIFFSBERECHTI-GUNGEN MIT ENTSPRECHENDEN MECHANISMEN UNVER-ZÜGLICH ZU WIDERRUFEN, UM EINEN UNBERECHTIGTEN ZU-GRIFF AUF DIE APP ZU VERHINDERN.

7. Beendigung des Vertragsverhältnisses

Sowohl SmartStamp als auch Sie können diese Vertragsverhältnis jederzeit kündigen. Ungeachtet der vorstehenden Bestimmungen kann SmartStamp dieses Vertragsverhältnis nur mit einer Frist von zwei Wochen kündigen. Das gesetzliche Recht der Parteien, dieses Vertragsverhältnis aus wichtigem Grund fristlos zu kündigen, bleibt unberührt. Insbeson-dere ist SmartStamp berechtigt, dieses Vertragsverhältnis sofort im Falle einer von Ihnen begangenen wesentlichen Verletzung der in den AGB festgelegten Bedingungen fristlos zu kündigen. Die Beendigung des Vertragsverhältnisses führt zum Entzug Ihrer Nutzungsberechtigung an der App; die Nutzung der App ist unver-züglich einzustellen.

8. Änderungen der AGB

SmartStamp kann diese AGB mit einer angemessenen Ankündi-gungsfrist ändern. Widersprechen Sie der Änderung nicht innerhalb einer von SmartStamp angemessenen gesetzten Frist, gilt die Än-derung als genehmigt. SmartStamp weist Sie in der Änderungs-An-kündigung darauf hin, dass die Änderung wirksam wird, wenn Sie nicht binnen der gesetzten Frist widersprechen. Beim Vorliegen ei-nes Widerspruchs kann SmartStamp das Vertragsverhältnis mit ei-ner Frist von zwei (2) Wochen kündigen. SmartStamp kann Informationen und Erklärungen, die das Vertragsverhältnis betref-fen, an die E‑Mail-Adresse des Kunden schicken.

9. Anwendbares Recht und Gerichtsstand

Für Streitigkeiten aus diesem Vertrag, auch über dessen Zustande-kommen gilt der Sitz von SmartStamp als ausschliesslicher Ge-richtsstand. Es wird schweizerisches Recht vereinbart.

10. Sprachfassungen

Sollten zwischen der deutschen und der englischen Version dieser AGB unterschiedliche Interpretationen möglich sein, so gilt die deut-sche Version.
